Repair access does not create a clearing exemption

DEP’s mangrove FAQ advises contacting the district with photos before relying on an alteration exemption for vegetation affecting a seawall. Trimming provisions are not blanket permission to remove mangroves for a barge landing or equipment route.

Describe what will be cut, where equipment will stand and whether the project changes the wall footprint. Ask DEP South District to identify the authorization or exemption that fits the entire activity.

What should the environmental review include?

Show both the permanent repair and the temporary construction footprint. An unchanged wall line does not answer what happens to vegetation or habitat while equipment reaches it.

Permanent work

Mark the existing wall, proposed replacement line, rock footprint, drainage outlets and any structure to be removed. Give the reviewer a clear before-and-after description tied to the site plan.

Temporary access

Show the barge approach, landing or loading area, staging space and any trimming or removal proposed along that route. Explain whether an alternative would avoid the vegetation.

Existing setting

Photograph the vegetation and shoreline before work. Identify nearby habitat or preserve questions for the reviewing agency; a regional map is context, not a parcel determination.

Use preserve maps for context, then verify work limits

DEP’s coastal management plan says Rookery Bay Reserve surrounds but does not include Marco Island. That distinction does not mean every island shoreline activity is unrestricted. Aquatic-preserve boundaries, submerged lands and habitat can still matter at the actual work location.

The reserve management plan supplies regional estuary and watershed context around Goodland, Isles of Capri and Faka Union Bay. Ask the reviewing authority to identify the relevant boundary on the site plan rather than assuming the whole neighborhood has one status.

A Gulf beach project needs its own jurisdiction review

A beach-facing erosion problem is different from replacing a wall on a residential canal. DEP has a separate Coastal Construction Control Line program. Identify the legal work location and proposed equipment route before applying a canal-seawall checklist to Gulf-front work.

Near Caxambas Pass, respect FWC’s posted Critical Wildlife Area and its April 1–August 31 closure period. Those protections concern the designated area; they do not mean every nearby private waterfront is closed.

Send a focused question to the agency

  • Parcel address and a site plan locating the shoreline and proposed work.
  • Dated photos showing vegetation, existing structures and water-side conditions.
  • Wall repair, replacement, riprap or drainage scope, with equipment access shown.
  • Any proposed change in footprint or removal of vegetation.
  • Existing approvals, agency correspondence and the project professional’s contact information.

What should you keep after the agency responds?

Keep the response with the exact plan and scope you submitted. A verbal description such as “mangrove work is exempt” leaves too much unclear when a crew arrives with a different access plan.

  • Record the agency contact, date, reference number and the activity addressed.
  • Have the project professional explain work limits, vegetation protection and any timing or reporting conditions.
  • Show the contractor the approved or verified access area before clearing or moving equipment.
  • If the footprint, method or vegetation work changes, ask the reviewing office whether the earlier determination still applies.
